By-Laws

ARTICLE 1
CONDUCT OF ELECTIONS

The Elections Committee, or its designee, shall conduct all general and special elections of the organization. All nominations and elections shall be conducted in accordance with the Labor Management Reporting and Disclosure Act of 1959 (Landrum- Griffin Act.)

Section 1. The Elections Committee shall be constituted for the biannual general election of officers and the members of the Steering Committee.

Section 2. To be nominated, a candidate must submit to the Elections Committee or its designee a petition containing the signatures of two (2) members of the organization for the office sought. Said petitions must be received no later than fourteen (14) days following the notice of the opening of nominations.

Section 3. The Elections Committee, or its designee, shall prepare and send ballots in such manner as to insure the secrecy of the ballot no later than fourteen (14) days following the close of nominations.

Section 4. Each member in good standing shall be entitled to one vote.

Section 5. Ballots shall be returned to the location specified by the Election Committee by the date and time established. Normal procedures to insure the security of the election process shall be followed by the Elections Committee.

Section 6. A majority of the ballots cast shall determine the election. In the absence of a majority the Elections Committee or its designee shall conduct a run-off election among the two candidates who have received the most votes for the office in question using the procedure specified in Section 2.

Section 7. Successful candidates shall assume office thirty (30) days after the conclusion of the election.

Section 8. With the exception of the President, or in case of a recall, all vacancies shall be filled by appointment by the President upon majority vote of the Steering Committee.

Section 9. A petition signed by sixty (60) members or thirty per cent (30%) of the membership, whichever is smaller, and stating specific grounds, shall be sufficient to require the Elections Committee to conduct a recall election of any officer specified in the petition under the procedures in Section 2. If an officer is recalled, the Elections Committee or its designee shall hold a special election under the procedures in Sections 1 and 2.

Section 10. Sample Chronology for Elections

  • March 1: Elections Committee constituted.
  • By or Around Spring Break: Nomination forms mailed.
  • April 17: Nominations end.
  • May 1: Ballots mailed.
  • June 1: Election results announced.

Section 11. Proposed amendments to these By-Laws shall be submitted, in writing, at a meeting of the Steering Committee. Amendments shall be voted on at the next Steering Committee meeting, following that in which it was proposed. Amendments to these By-Laws shall be approved by a two-thirds (2/3rds) majority of those present, given quorum.
